These Terms of Use ("Terms") govern your use of the Enspirawerks website and the RideAhead mobile application (together, "the Services"), operated by Enspirawerks LLC, a Texas limited liability company ("Enspirawerks," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Safety First — Read This
RideAhead is a navigation aid, not a substitute for your judgment. Always obey traffic laws, posted signs, and road conditions. Do not interact with the App while your motorcycle is in motion. Routes, fuel stop suggestions, and arrival estimates are computed from third-party data that may be incomplete, outdated, or wrong — fuel stations close, roads change, and GPS positioning has inherent error. You are solely responsible for your safety, your fuel planning, and every riding decision you make.
2. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use RideAhead on devices you own or control, subject to these Terms and the rules of the app store from which you downloaded it. You may not copy, modify, reverse engineer, resell, or redistribute the App or any part of it, except where such restriction is prohibited by law.
3. Accounts, Purchases, and Subscriptions
- Certain features (such as additional custom favorites or premium routing options) may require a one-time purchase or subscription, processed by Apple or Google. Pricing is shown in the App before you buy.
- Subscriptions renew automatically unless cancelled through your app store account settings. Refunds are handled by the app stores under their policies.
- We may change, add, or retire features over time; if a change materially reduces a paid feature you actively use, we will make reasonable efforts to notify you.
4. Acceptable Use
You agree not to misuse the Services — including attempting to disrupt them, accessing them by automated means, using them to violate any law, or infringing the rights of others.
5. Intellectual Property
The Services, including the RideAhead name, the Enspirawerks name and logo, software, and content, are owned by Enspirawerks LLC or its licensors and are protected by intellectual property laws. Map and routing data are provided by third-party licensors and remain their property.
6. Privacy
Our Privacy Policy explains what information the Services collect and how it is used. By using the Services, you consent to those practices.
7. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ROUTES, FUEL STOP DATA, OR NAVIGATION GUIDANCE WILL BE ACCURATE, COMPLETE, OR UNINTERRUPTED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENSPIRAWERKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS — ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify and hold harmless Enspirawerks LLC from claims arising out of your misuse of the Services or violation of these Terms.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including 5, 7, 8, and 9) survive.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute shall be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction. [OPTIONAL: consider an arbitration clause — discuss with an attorney.]
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use of the Services after changes take effect constitutes acceptance.
